In civil-law matters, lawyers‘ fees are generally determined by the value in dispute and are governed by the German Lawyers‘ Remuneration Act (Rechtsanwaltsvergütungsgesetz – RVG). A lawyer is also entitled to request an advance payment for work on a matter.

For out-of-court matters, § 4(2) RVG permits remuneration agreements, including flat-rate or time-based fees, which may be lower than the statutory fees provided for by the RVG.

In matters that cannot be handled economically on the basis of the statutory fees, I may propose a separate fee agreement. Depending on income and the circumstances of the case, clients may also be eligible for state-funded legal advice assistance or legal aid for court proceedings.

If you have legal expenses insurance, the insurer may cover lawyers‘ fees and court costs within the scope of the relevant insurance policy.

Before instructing a lawyer, you should generally request an overview of the likely cost of advice or court proceedings. I will be pleased to discuss the expected costs of litigation with you in advance. This enables you to assess the likely financial exposure of a dispute.

Ongoing advisory agreements can be particularly suitable where it is foreseeable that legal assistance will be required repeatedly over a particular period or for a specific project.

Examples include the activities of property managers and founders of businesses.
